Lindbergh vai ao STF contra investigação ilegal encomendada por deputado do PL

Em defesa das garantias constitucionais e do devido processo legal, o deputado federal Lindbergh Farias (PT-RJ) acionou o Supremo Tribunal Federal (STF) para suspender e anular um inquérito ilegal conduzido pela Polícia Legislativa da Câmara. A investigação, aberta a pedido do deputado de oposição Alfredo Gaspar (PL-AL), atropelou as regras jurídicas ao realizar diligências e quebra de sigilo sem a necessária supervisão do STF, que detém a competência exclusiva sobre atos de parlamentares federais.

A reclamação constitucional, encaminhada ao ministro Gilmar Mendes, aponta que a estrutura de segurança da Câmara foi instrumentalizada para perseguir um adversário político. Sem qualquer controle judicial, o órgão legislativo requisitou dados telefônicos e avançou sobre fatos ocorridos fora das dependências do Congresso. A defesa de Lindbergh sustenta que uma resolução interna da Casa não pode se sobrepor à Constituição, que confere à Polícia Federal a função de polícia judiciária da União sob supervisão do Judiciário.

O caráter político da investida fica evidente no perfil da suposta testemunha que embasou o caso, Luiz Antônio Lopes. Apenas uma semana após prestar o depoimento contra o parlamentar petista, Lopes filiou-se ao PL, mesmo partido de Alfredo Gaspar. Além disso, o autor das acusações é um militante de extrema-direita que participou ativamente dos atos golpistas de 8 de Janeiro de 2023 e acumula publicações nas redes sociais com ameaças violentas ao ministro Alexandre de Moraes e ofensas ao presidente Lula.

Diante do flagrante desvio de finalidade e do risco de que o aparato do Legislativo seja usado para perseguições políticas, Lindbergh pede a anulação total do procedimento. O deputado também solicita que o caso seja enviado à Procuradoria-Geral da República (PGR) para investigar a legalidade da conduta dos envolvidos e apurar a hipótese de falso testemunho sob promessa de recompensa.
